Signing or submitting this agreement electronically authorizes Isaacs Pools & Spas LLC
to inspect the swimming pool and/or spa at the address where service is being
requested. If the swimming pool and/or spa or related equipment needs repaired,
repairs must be completed at the owner’s expense and should also be clean and
operable before this agreement will become effective. Isaacs Pools & Spas Service
Department may decline to accept this agreement for any reason. The owner may
cancel this agreement if there are any pre-maintenance repairs or water chemistry
corrections required that would result in additional charges or any recurring rate
premiums above the visit rate initially stated in this agreement.
By signing this agreement, you authorize Isaacs Pools & Spas to charge your credit
card at the monthly rate stated above. You will be automatically charged at the first of
each month unless you request to cancel the service (see #4 for cancellation terms). If
your credit card is denied for any reason, we will contact you for updated information. If
we are unable to obtain accurate credit card information, we will not perform the
maintenance until the information is obtained.
Pool Maintenance Includes: clean skimmer baskets, clean pump baskets, skim debris
from the water, vacuum pool, brush steps and walls, backwash filter (if needed), check
pool systems, check water chemistry, and add chemicals as needed.
Spa Maintenance Includes: vacuum spa, check filters and clean as needed, wipe down
spa interior shell, on-site water analysis, chemical adjustments, clean spa cover and
spa exterior cabinets with 303 Aerospace Protectant (or equivalent) once a month.
Additional services: Any additional maintenance and/or repair services needed can be
priced upon request, billed, and performed during your regularly scheduled
maintenance visit. *In the event the pool and/or spa is inundated with leaves or trash
(typically in the fall), customers will be billed $75 (subject to change) per hour after the
first 45 minutes (the normal amount of time to perform the maintenance) for leaf and/or
trash removal.

If you choose to have the maintenance service performed on both your pool and spa,
the contracted rate will be discounted for the summer months when both the pool and
spa are running and being serviced. At the time that your pool is winterized, and you still
want valet service at your spa, your price per visit rate will be the normal valet service
rate without a discount.
Billing for chemicals used during the service will be on the next monthly statement in
addition to the standard monthly rate. (i.e., chemicals used in January will be charged
on the February 1 statement.
This agreement shall have a minimum duration of one hundred twenty (120) days
unless waived by Isaacs Pools and Spas LLC. At the end of one hundred twenty (120)
days, the agreement is cancelled by either party upon a thirty (30) day written notice.
This agreement is between Isaacs Pool & Spas LLC, and the OWNER of the property,
who must sign or accept this agreement. A tenant may request service under this
agreement but will be required to pay a $100.00 security deposit and place a credit card
on file with Isaacs Pools & Spas for automatic recurring billing. The security deposit will
be refunded upon proper cancellation of this agreement, if all the bills pertaining to the
pool and/or spa have been paid.
If you desire a maintenance plan for fewer than ninety (90) days, it is considered a
temporary plan and should be paid in advance at a rate of $10.00 per month above the
normal agreement rates. After 90 days, the owner may decide to extend the temporary
plan. At that point, the owner would then pay monthly and the $10.00 per month
increase will no longer apply.
Isaacs Pools & Spas, LLC will maintain water chemistry parameters in accordance with
the Pool & Hot Tub Alliance recommendations. Nevertheless, the possible natural
degradation of the pool and/or spa interior is inevitable and will be considered normal
wear and tear and cannot be warranted by Isaacs Pools & Spas LLC.
Severe inclement weather, other acts of nature, or vandalism that cause an excessive
accumulation of dirt and require extra labor and materials are not considered normal
circumstances. Additional customer billings may result while performing this additional
work.
If your regularly scheduled maintenance day falls on a holiday including New Year's
Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, or Christmas

Day, we will try our best to reschedule your maintenance for the day before or after the
holiday.
If pool, pool systems, spa, and/or spa equipment are found to require service, the
homeowner shall be notified of the cost for the service/repair.
Jurisdiction and Venue:
Resolution of all disputes arising pursuant to this agreement shall be in the Courts of
Competent Jurisdiction located in Washington County, Tennessee, as appropriate. The
parties submit to the jurisdiction of said Courts and agree that venue is proper in such
Courts. If the Company is required to sue the Customer or take any other measures,
including hiring an attorney, to collect sums due under this agreement, the Customer will
be responsible for all expenses incurred, including court costs and attorneys’ fees.
